Part I: I need a brief summary of the decision in In re: Motors Liquidation Co., No. 13-2187 (2d Cir. 2015)

Part II: Assume you have been tasked with outlining an argument in favor of, or opposition to, Chase’s petition for rehearing en banc to the full Second Circuit. (In a petition for rehearing en banc, the party which was unsuccessful before original three-judge appellate panel asks the entire Circuit Court to reconsider the panel’s decision.)  You choose which side you want, i.e. either Chase or the Creditors’ Committee. Set forth your arguments for the position you choose, i.e. either in favor of the decision or asking that it be reconsidered.
